The Anchorage district attorney has decided not to file charges against a woman in connection to the shooting death of a man early Tuesday morning.

Dispatch received a report of a suicide in the 1200 block of LaTouche Street around 12:30 a.m., according to a press release from the department. When officers arrived on scene, they found a man inside of an apartment shot in the upper body. He died after being transported to a local hospital.

An investigation found that a group of adults and juveniles were inside the apartment drinking and smoking marijuana, Anchorage Police Department spokesperson MJ Thim said. The group was passing around a gun brought to the residence by the victim. At some point, the gun was handled by a woman and a shot was fired. The bullet struck the victim, the release stated.

After interviewing witnesses, police identified the woman as 26-year-old Marilyn Tilo-Maiava. She was arrested on charges of manslaughter and criminal negligent homicide, however Tuesday afternoon Anchorage District Attorney John Novak chose not to pursue the charges at this time.

"In this case, I — as the head of the Anchorage DA's Office — have decided the appropriate thing is to not file charges today," Novak said in a phone conversation.

Novak explained the decision was made after conferring with APD and does not mean that charges will not be filed in the future.

Police are not releasing the victim's name at this time, pending family notification.

Editor's note: This story has been modified to reflect APD's corrected age and last name of the suspect.
