FAIRBANKS — A North Pole man found guilty of federal crimes along with Fairbanks militia leader Schaeffer Cox has filed a notice of his intention to appeal the conviction.

Coleman Barney filed the paperwork with the 9th U.S. Circuit Court of Appeals on Sept. 26, two days after he was sentenced in U.S. District Court in Anchorage.

Barney, 38, was sentenced to five years in prison for his part in the Alaska Peacemakers Militia plot to kill government officials.

Barney was convicted in June of conspiracy to possess unregistered silencers and grenades and of possession of an unregistered 37mm projectile launcher loaded with an anti-personnel round that contained rubber pellets.

The jury deadlocked on a murder conspiracy charge against Barney and acquitted him of two other weapons charges.

Cox and militia member Lonnie Vernon are scheduled to be sentenced Nov. 19 on several charges, including conspiracy to commit murder.

The three were arrested in March 2011 in the Fairbanks area.

Barney’s appeal brief is due at the appeals court on Dec. 26, with the government’s response due Jan. 25. Barney then has 14 days in which he can, if he chooses, file a response to the government’s appeal reply.
