A judge has ruled that Bill Allen must be in Fairbanks for the retrial of a former Alaska lawmaker even if he doesn't take the stand.

U.S. District Court Judge Ralph Beistline ruled Allen must be in Fairbanks by the start of former Alaska lawmaker Vic Kohring's retrial on federal corruption charges.

Allen was the star witness in the first trial that saw Kohring convicted.

But a judge later overturned that conviction and ordered a new trial because of possible prosecutorial misconduct.

Allen’s credibility was damaged during the trial of former U.S. Senator Ted Stevens, R-Alaska; the U.S. Bureau of Prisons will bring him up from New Mexico.

Federal prosecutors decide whether Allen will testify at Kohring's retrial set to begin Oct. 31.
