Alaskan Homesteader Ousted Due to Unpaid Property Taxes

An Anchorage man says the city is forcing him out of his home because of unpaid property taxes on land that he's homesteaded for over 50 years. It's a case that some say points to the need for a more diversified tax base.

When 83-year-old Jimmy Lockhart came to Alaska in the late 1940s, he had a dream of building a good life and a home over on Randolph Street in Anchorage. He created his home with his own two hands and it’s now in danger of being lost to foreclosure because he can't afford to pay his property taxes.

There's nothing but pride and joy when Jimmy Lockhart talks about his longtime home. But that joy is turning into frustration for a man who has put his heart and soul into the place he built, all because of property taxes he can’t afford.

“It started out [at] about $5,000, now it’s up to $16,000,” said Lockhart—$16,847 to be exact. With a fixed income from his social security check, Lockhart's effort to fight for grandfather rights on the land he has homesteaded since the 1940s has so far been denied.

“That don't work too good with the municipality. They don't read those things,” said Lockhart.

Mayor Sullivan’s spokesperson Sarah Erkmann said in a statement that Lockhart did receive a senior exemption in 2010 and that along with residential exemptions totaled $170,000.

But the value of his property exceeds the exemptions and outstanding taxes, and so his house is being foreclosed.

The Sullivan administration said this case shows Anchorage’s need to add more options to how the city gets taxes so Alaskans who have paid off their houses won't be put out on the streets.

With longtime Alaskans like Jimmy losing their homes because of property taxes, many question what can be done to adjust the tax base. Some Anchorage Assembly members say the solution could involve a sales tax.

“Whenever tax payers have the ability to control how much tax they want to pay, I think it’s a good thing,” said Anchorage Assembly member Adam Trombley.

“With a property tax you don't have that leeway. You’re going to pay that or else you are going to lose your home. The nice thing about a sales tax [is] if you have hard times or [a] hard month you’re able to control how much tax you spend because you are able to control how much you purchase.”

Assembly member Elvi Gray-Jackson said a sales tax has been put before the Anchorage community many times in the past, and only 30 percent of voters were in favor in its last round at the polls. “I can't really say it’s a solution,” she said.

Even so, the change in the tax base would be too late to save Jimmy Lockhart’s home.

“I feel real bad because this is what I was going to retire in. Now you’re getting pushed out,” said Lockhart.

His home on Randolph Street is part of a list of nine properties that will be sold on June 16 in a city foreclosed property sale. Lockhart said he is not giving up and will fight legally to keep it.

In the meantime, assembly members said the discussion over diversifying taxes, including a sales tax, will be considered to ease the financial burden on Anchorage residents.

I know Jimmy Lockhart. His brother is a multi-millionare. I have two unpaid court judgments against him. Countless other people do as well. His property is an income producing duplex, and I believe he has other properties as well. He's probably wealthier than all the people who are offering to pay his taxes. Go give your money to the real homeless, and do your homework before you part with any money.

This 'gentleman' stole $16,000 from my family many years ago. Maybe he should have saved it and used it to pay his taxes now!

That guy has stole money from helpless people for years. Look at all of the Judgments against Lockhart. He is no innocent victim. He is just getting what he deserves. He could have sold that house and lived comfortably on the money. Instead he chose to lose it over $15k in taxes. He is just trying to get out of paying taxes.... like it or not, we ALL have to. He is no better than you and me. Come-on.... that house is worth $200k..... he is not homeless.

Why can't they just claim the land when he passes away and let him live there until then? This is insane. They hate the poor, the homeless, and the elderly.

There is a new Face Book page, "Help Save Jimmy Lockhearts Home", we are attempting to raise enough money to save the home, please spread the word, also if anyone knows of family please ask them to leave a message with contact information, so we can keep them posted of the progress being made. I believe this community can come together and show this man Alaska cares and save his home. Letss get behind this and see just how big of an impact we can make!!

What can be done to help him? Simple- 1. Nobody bids on his property. 2. 16,847 people (a very small percentage of Anchorage's population) send a dollar to the city, along with a letter of protest/outrage. The taxes get paid, and the corrupt politicians get a strong message. 3. Next election we start voting out the corrupt politicians.

83 yrs old and being ousted from his home!! Well I'm not surpised. Sounds as fishy as everything esle these days. I find it really hard to believe the people of Anchorage, want to pay these rediculously high property taxes over sales taxes. I'm going through the same thing as this poor man only at a lower scale. My husband came home from work every night for yrs. He cleared our property and build us a beautiful home, now due to the high property taxes, I have to sell. This greedy, 'all for me and none for you' attitude is pure BS.

This is the Deal I propose. Obviously we as a society cannot afford not to be taxed LOL. I say we as individuals are able to own 2 acres of land for personal use that is not taxable. Anything else including other property is taxed. Like that third acre,that rental property that get away hunting sanctuary, that posted land and that claim you cant afford to work. If I own somthing I want to own it. Dont tell me what I can and Cant do with somthing I own. As long as im not hurting or indangering my community who cares. Paying taxes for something that is sposed to be mine is not right. I know all about culture you want americans to take pride in the things they own then stop taxing the things that are sposed to be ours. Call a tax on anything over 2 acres luxury. Property taxes are BULL SHT

Same things happening to our family. My husband came home from work every night for years, cleared our property, built our home, and didn't stop still he died 8 mos ago. The property taxes are so high now that the kids and I have to sell. AMEN, Moosewhisper, we need a sales tax. But will they actually do away with property taxes after all this time? Kind of reminds me of the toll roads on the east coast. Some were suppose to be lifted once the road was paid for....never happened. This poor man is 83 yrs old. How dare they push him out!!

This is just so wrong. There should be someway to help this gentleman. At 83 his days are numbered anyway and to kick him out into the streets is truly disgusting. 40 plus years in Alaska. He is a true ALASKAN and one who helped build this city. It's all about greed and money with the government and banks. The man should be given a exemption. If he were a 20 year old I wouldn't be so understanding but an 83 year old man who has been here since the 1949's, built the house with his own hands. Not a single politician is stepping in trying to help the man. Our government is truly disgusting and all of them should be put out on the street if they do this to this gentleman.

Again, sales tax is the best solution! The money is easier to pay a small piece at a time instead of having to cough it up in a lump sum, once a year. Why do we let ourselves risk being evicted from the most important part of the American dream? Is the municipality for us or against us?

What we should be asking is what they realy want the property for ?? Thats his space leave him alone.I know when you get to be a sertin age you dont have to pay taxes.As a kid adults in my life would tell me you will never own a thing if you dont pay your taxes they will ortake your place.

This is just wrong! Where is he supposed to go? He's 83 years old! This gentleman worked his whole life to secure this property. He is truly a real Alaskan, one of those who helped build this great state. There must be something someone can do.......

It just goes to show you how damaging property taxes are. This man homesteaded and worked hard for this land thinking he actually owned it, just to be ejected from it. In most places in this country you never own the land, you pay for 30 years to pay it off just to find out that there is someone else who actualy owns it and can take it away from you if you don't pay your "rent".
